1. Scope and seller
These terms apply to all orders placed in the online shop modamixtr.com. Your contractual partner is Moda Mix, owner Malek Mohammed Nasif, Hauptstraße 28, 42651 Solingen, Germany (full details in the legal notice).
2. Conclusion of contract
The products shown in the shop are not a legally binding offer but an invitation to order. By clicking “Buy now” you make a binding offer to purchase the items in your cart. Before sending, you can review and correct all details at checkout. The contract is concluded when we confirm your order by e-mail (order confirmation) or ship the goods.
3. Prices and shipping costs
All prices are final prices in euros including VAT. Shipping costs are added and shown at checkout before you order; details in Shipping information. Deliveries outside the EU may be subject to import duties and taxes of the destination country, payable by the recipient.
4. Payment
You can pay by credit or debit card, Apple Pay, Google Pay, Klarna, Amazon Pay, Scalapay or Satispay; available methods depend on the delivery country. Payments are processed by Stripe. For pay-later or instalment purchases via Klarna or Scalapay, their terms also apply. The purchase price is due when the contract is concluded.
5. Delivery
We deliver to the countries offered at checkout. Orders received on a working day before 12:00 noon (German time) ship the same day, otherwise the next working day. Delivery times are listed in Shipping information. If an item unexpectedly becomes unavailable after your order, we inform you immediately and refund any payment made.
6. Retention of title
The goods remain our property until paid in full.
7. Right of withdrawal
Consumers have a statutory 14-day right of withdrawal. Details, the model withdrawal form and our voluntary services (exchange, store credit with bonus) are on Returns & exchanges. The easiest way to register a return is our return form.
8. Warranty and transport damage
Statutory warranty rights apply. Please report visible transport damage to the carrier and to us as soon as possible; this does not affect your statutory rights.
9. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. For slightly negligent breaches of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.
10. Customer account
Creating an account is optional. Please keep your login details confidential. You can have your account deleted at any time by e-mailing [email protected], unless statutory retention obligations prevent this.
11. Contract languages and contract text
Contracts can be concluded in German, Arabic or English. We store the contract text; you receive the order details with the order confirmation and can view them at any time via the link in that e-mail or in your account. You can save or print these terms from this page.
12. Applicable law and dispute resolution
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law does not deprive them of the protection of mandatory provisions of the country of their habitual residence.
